Hmmm... I thought the reason Fonda could not be prosecuted was that Congress neglected to declare war on N. Vietnam- -because the Prexy, good old LBJ (may his soul rot in Hell) neglected to ask it to. Treason is defined in the Constitution: ARTICLE III Section 3. Treason against the United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort. No person shall be convicted of treason unless on the testimony of two witnesses to the same overt act, or on confession in open court. My understanding is that, because Congress never declared war, N. Vietnam was not legally an enemy, and therefore Fonda (or anyone else) could not legally commit treason. Other than that minor quibble, yes, she commited treason.
