Did you really not understand our conversation today? Of course HITT thinks it has merit—but if their case is so darn strong, and they keep blaming it on the Bloomberg article, then why are they too afraid to take on Bloomberg, Dave? I'm sorry it escaped you this morning, but anybody can file a stupid suit because they think it has merit. That certainly doesn't mean it actually has any merit. That was the precise point of my petunia example, which you apparently didn't get. If HITT's version of the story is true, and Bloomberg's is not, then it would be a slam-dunk case for HITT. And obviously, the converse is equally true.
