TexasDude, this is my understanding about Liquid Audio and WAVX

Think of WAVX's Embassy chip as being a lower level product underneath the Liquid Audio's of the world. The LA's will quickly discover that their software protection schemes are inherently insecure. I believe that all of the digital distributors will eventually end up having to strike a deal with WAVX. The WAVX Embassy chip will serve as the underlying vehicle to allow the secure distribution of their digital goods.

The marketplace will determine the percentage that WAVX will be able to charge for its secure digital distribution services to the Liquid Audio's vendors. This still hasn't really been settled.

Remember the question isn't software vs. hardware. It is whether the the WAVX Embassy chip solution is secure enough. Everything else has already failed miserably.
