Is DTC a defendant in the Mann case? Well, let's turn to the transcript of the January/February hearings, shall we?
4 MR. COOPER: William Cooper on behalf of 5 Depository Trust Company. Your Honor, also, with me is an 6 attorney from New York, Isaac Montal, M-o-n-t-a-1, the 7 Proskauer Rose firm. He's the lead counsel for Depository 8 Trust Company. 9 We filed a petition for permission to practice in this 10 case only. The appropriate fees have been paid. It's on 11 file pending disposition by the Court. I'd ask that he take 12 the lead today on behalf of Depository Trust Company. 13 THE COURT: There's no problem. I'll authorized 14 him to practice for purposes of this case, actually. And 15 you're more deeply involved. The amended complaint names 16 you, and some question has been raised as to the 17 appropriateness of that. 18 I'm not sure that the suggestion that the amended 19 complaint required the consent of the Court, but we can deal 20 with that later. There are a number of other procedural 21 things. And I don't think that the plaintiffs have 22 responded to that motion. 23 MR. COOPER: No, they haven't. 24 THE COURT: Okay. 25 MR. COOPER: It was both in opposition to the

1 motion for injunction and a separate motion to dismiss on 2 behalf of DTC. 3 THE COURT: Yes. And you've joined in that 4 motion. 5 MR. COOPER: Yes. 6 THE COURT: Okay.
I tried to explain to Pugs what this means. The Court says:
1. That AZNT's inclusion of DTC in the complaint has been challenged as being "inappropriate".
2. That he isn't sure whether determining the appropriateness of DTC's inclusion falls within his purview, but will examine the issue at a later date.
3. That a second issue to be decided is whether DTC is to be bound by the 2 October injunction.
The Court has yet to rule definitively on either issue. |
