Dismissal of lawsuit against DPS affirmed

MARKHAM, ON, July 13 /CNW/ - Digital Processing Systems Inc. (TSE - DPS)
announced today that the United States Court of Appeals has unanimously
affirmed the earlier dismissal, without prejudice, of two patent infringement
lawsuits filed against DPS in Ohio by Carl Cooper and his affiliates. None of
the relief sought by Cooper and his affiliates was granted.
The lawsuits had alleged that certain DPS' products infringed patents
held by the plaintiffs. The Ohio trial court ruled that another party, Video
Processing Technology, which claims that it and not Cooper has ownership of
and the right to enforce the patents in question, is a party that is necessary
and indispensable to the case, but over whom the court does not have
jurisdiction. The Ohio court did not rule on the patent infringement issues
involved in the lawsuits.
DPS continues to vigorously defend a separate lawsuit filed in California
by Cooper and his affiliates against DPS and its wholly-owned U.S. subsidiary
alleging that certain DPS products infringe another patent held by Cooper.
