Ottawa rebuked in two tender complaints
After an out-of-court settlement with Corel Corp. for $9.9 million, the federal government has had its knuckles rapped by a tribunal for two more violations of its own tendering rules.

The Canadian International Trade Tribunal, which functions as a watchdog for government suppliers, has found that contracts involving both the Defence Department and the Human Resources Department were awarded to Microsoft Corp. without public tender, against federal procurement rules....

In both cases the Public Works and Government Services Department acted as procurement agent for the departments.

The plaintiff in both cases was Novell Canada Ltd., which argued before the tribunal it should have been given a chance to bid for the contracts, both involving computer network server licences.

In the Human Resources case, the tribunal ordered Public Works to cancel the contract to buy 600 Microsoft NT server licences and that a tender be put out with specifications drafted in generic terms so they apply to other companies besides Microsoft.

The tribunal said reasons for its decision will come later....

...In the Corel case, the government tried to overturn the tribunal ruling in Federal Court but the appeal failed.

Walter Robinson, spokesman for the Canadian Taxpayers Federation, said Tuesday the three cases show something is wrong in the way Ottawa does business...
