Yes, it does sort of look like it's up to the market maker to decide if he/she has complied with the financial dd requirement. They only call the SEC if they have a question. Pretty pathetic regulation. The proposed rulemaking (but not the present one) puts a little more teeth into it. If that's the case, then what does this suspension mean? Gotta think about this.
