My guess is that, at worst, the consumer electronics company(ies) which contract with e.Digital to manufacture the music players will have to pay a royalty/license fee to Audiohighway for rights under the patent (if it is deemed to apply).

The press release from Audiohighway implied that this was the direction they intended to take with their patent, rather than force everyone else out of the business. So I would view the potential effect on e.Digital as minimal. It may increase the eventual price to the consumer, but should not stop the market from developing.
