1. No, not all modems are software upgradable. Go buy a 14.4 at deep discount and you'll have a problem. Go buy the competition's old (and many current) models and you'll have a problem. But what's this got to do with anything?: all USR modems now on sale are software upgradable, and when ROK et al. gets their act together theirs will be too.
2. A little Earthspeak here: the correct term for USR's proprietary technology is x2. The generic term is 56K. ROK does 56KFlex, its own proprietary technology.
As for the rest of it, the real point is that--as users who contribute to this thread (and others) have discovered--most, if not all, people who try x2 find they get much better connect speeds than they had previously. (Interestingly, Derek is using a x2 modem without having a x2-enabled ISP, and finds that for the first time he can regularly connect at 33.6.)
And, ah, Paul really does know what he's talking about: read back a bit on the thread.
