Dayton reply, critical sections are as follows if my eyesight did't deceive me:

"Dayton does not have at present, nor did it ever have in the past, nor does it plan to have in the future, any position, long or short, in the stock of Medinah Energy or Medinah Mining."

"There was a recent (June 14, 1999) article in Business News Americas ("BNA")regarding the litigation between Dayton and Medinah Energy. Our CFO, Don MacDonald, was interviewed over the phone by BNA, and due to the number of cases and parties involved, and possibly a language problem, the resulting article contained an error. This error was addressed by BNA in clarification article published on June 16, 1999."

"Medinah filed 3 cases against Dayton and its subsidiaries. One was filed in Canada against Dayton Mining Corporation, (a Canadian Company), and the other two were filed in the US. One of the US cases was against Dayton Mining Corporation and the other against Dayton's US subsidiary. The US casE against Dayton Mining Corporation was dismissed as the court ruled there was no jurisdiction for the case against the Canadian company in Nevada. The case IN Canada against Dayton Mining Corporation and the case in the US against Dayton's US subsidiary are still pending."

"Below (with apologies to BNA for any copyright infringement) is the text from two BNA articles pertaining to Dayton:" (I WILL ONLY COPY THE SECOND ARTICLE, WITH A SIMILAR APOLOGY TO BNA, IF THERE IS ANY COPYRIGHT INFRINGEMENT)

"Medinah vs. Dayton: Clarification-Regional
June 16, 1999
The Medinah Energy court case against Dayton Mining Corp of Vancouver (Amex:Day)has been thrown out by a US court, and not a Canadian Court, as BNA reported on Monday. Medinah Energy is now Medinah Mining (Nasdaq:MDIN), reflecting a corporate change to mining.
Source: BNA" THROUGH DAYTON EMAIL TO ME.

MY ACTIONS AND COMMENTS WOULD BE: 1. I AM TRYING TO CROSSCHECK DAYTON RESPONSE THROUGH BNA. 2. I WILL ASK MEDINAH TO ADD JUNE 16 ARTICLE TO THEIR WEBSITE. 3. IF MEDINAH SAW THE JUNE 16 ARTICLE, THEY COULD HAVE EASILY USED IT TO SAY DAYTON CHANGED THEIR STORY WHEN THEY WERE CAUGHT. THEY COULD HAVE REFERENCED THE STATEMENTS BY MEDINAH AND THEIR ATTORNEY. IT WOULD HAVE BEEN AN EASY WAY TO BOOST CREDIBILITY VS DAYTON. NOT PUBLISHING THE SECOND ARTICLE LEFT UNCERTIANTY AS TO THE LEGAL SITUATION AND A CREDIBILITY LOSS WHEN THE SECOND ARTICLE WAS REPORTED. PROBABILITY FAVORS THEIR NOT SEEING THE ARTICLE ALTHOUGH THE QUESTION THAT REMAINS, IF THEY SAW THE FIRST WHY DID THEY MISS THE SECOND. 4. I WOULD ASK DAYTON IF THEIR ATTORNEY RECEIVED THE LETTER FROM THE MEDINAH ATTORNEY. IF THEY DID RECEIVE IT WHY DIDN'T THEY RESPOND IN ABOUT A MONTH, IF NO RESPONSE WAS GIVEN. THEY SEEM TO HAVE HAD AN EASY RESPONSE, RETRACTION WAS GIVEN ON JUNE 16, EVEN IF THEY DECIDED NOT TO ANSWER ALL THE QUESTIONS FROM MEDINAH. WHY THERE WAS NO DAYTON RESPONSE IS A QUESTION I CANNOT ANSWER. STRANGE. THE FULL STORY HAS YET TO BE TOLD
