Auric - I hope you do have a "counsel" -- and I hope he's a good one (and not too expensive) because with remarks like your last post, I doubt you have seen your last lawsuit. You must have gonads the size of Godzilla (and a brain the size of Thumper's) to continue to make defamatory statements like you made about Van Gothner yesterday. If you have facts to back them up, share them. Otherwise, STFU.
I am not trying to stifle your "first amendment rights" big fella - the first amendment does not give anybody the "right" to publish false and defamatory statements about someone (any more than it protects the "right" to yell "fire" in a crowded theater). And reckless indifference to the truth is not a defense, even if the defendant is a public figure. You better have your facts and the law straight before you call people criminals or suggest that they have ties to John Gotti (which is my read of your prior post). I personally think you are completely wrong on both the facts and the law. But what else is new?
BTW - if you look at my posts over 1 1/2 years on Yahoo, starting in January 1998, you will see that I have been consistently critical of First United and their tactics, and was glad to see them go out of business. You can be critical of a lot of things about ATG's first 3 years of operation since the IPO without necessarily drawing the inference (as you always seem to) that it necessarily means that ATG is a bad company, or is some kind of pump and dump (which has been the essence of your view thus far -- a view that I think is demonstrably false). In most organizations (and I would assume that includes even the lowly First United), there are some good people and some bad people. I am not aware of ANY the criminal connections you imply existed with First United (you still have never shared the text of a legitimate journalistic article written by an objective party demonstrating the truth of your prior allegations in that regard). FWIW, I thought the people I interacted with at First United were pretty sleazy and untrustworthy, but that did not include Mr. Gothner, who joined ATG shortly after the IPO (that is to say, I never interacted with Mr. Gothner). IMHO, you need to be more careful who you smear with the very wide paint brush you tend to use when you are denigrating a company, as you so often do. The fact the First United was the investment banker on ATG's IPO does not mean ATG is illegitimate, or sleazy, or criminal, as you have implied in some of your prior posts. In fact, ATG has satisfied the SEC after 3 years of pretty intense scrutiny that it should be permitted to operate VTS through UTTC and REB Securities; it has achieved B/D licensing for REB and SEC approval over VTS. If your innuendos and statements were true, it is highly doubtful that those approvals would have ever occurred given the degree and nature of the scrutiny involved. And for all the bad things I could say about First United, I am still up over 150% on my investment in ATG within a 2-3 year period. Which makes the following point: Arguing against ATG now based on its investment banker, which went out of business over a year ago, is BS -- Ashton is an investment to be considered on its own merits (or lack thereof) - why don't you do all of us a favor - stick to the matter at hand and spare us the libel.
