SAN DIEGO (Dow Jones)--Qualcomm Inc. (QCOM) filed a new lawsuit that seeks to terminate licenses the company granted to Motorola Inc. (MOT), and to retain all licenses Motorola granted to Qualcomm under a 1990 agreement between the two companies.
In a press release Tuesday, Qualcomm said it filed the lawsuit in San Diego in the U.S. District Court for the Southern District of California where the two companies have each filed lawsuits related to their Patent License Agreement.
Qualcomm said its latest complaint alleges that Motorola breached the deal by, among other things, filing patent-infringement lawsuits over patents licensed to Qualcomm.
Qualcomm, which makes digital wireless communications products, said the new lawsuit also seeks to invalidate some patents formerly licensed to Motorola as soon as the companies' license deal ends. After the agreement's termination, Motorola's code-division multiple access, or CDMA, handsets and network infrastructure equipment would infringe Qualcomm patents, Qualcomm said.
Earlier complaints filed by the two companies are related to Qualcomm's "Q" phone, which Motorola says infringes its design and patents.
