Tunica, a final resolution of the Portland open access issue is currently being appealed to the Circuit Court of Appeals. It appears as though several amicus (friend of the court) briefs will be filed, including one by the FCC. We will not have a decision out of the Circuit Court for months. Then, the likelihood is that there will be a further appeal to the U.S. Supreme Court. Assuming the Supreme Court decides to hear the issue, which in all likelihood it will, that process will take many more months. IMHO, the issue of open access will not be finally resolved in the courts until well into 2000.
