The Nasdaq and the New York Stock Exchange, which are losing market share to the new systems, are reportedly exploring options to try to stunt the growth of the ECN industry, including a possible partnership between the two exchanges.

A year ago, Reuters-owned Instinet dominated the ECN market. But Datek's Island, now the No. 2 ECN, closed the gap. Of the top 10 Net brokers, Datek Online is the only one currently routing trades through an ECN, and in doing so it has separated itself from the pack by capturing the lucrative active-investor market.

Certainly Datek's nose must be held to the "grind stone" but the New York Times has a vested interest in reporting as much negative news as possible about Datek. I believe either NY City and/or the State paid $700 million dollars to retain the New York Stock Exchange.

Datek is being heavily scrutinized and surely would be follish to try any more "hanky-panky!" However, for Datek to spend $100 million dollars on advertising and NOT $50-$75 million on hardware and software infra-structure IMPROVEMENTS is unconscionable.
