Bosco, We are in complete agreement. It is a big grey area. And lawsuits mainly serve the ambulance chasers. I don't even know whether the alleged private discussions caused any changes in concensus earnings estimates. Even if estimates did change the next day, how could anyone determine whether it was because of the CEO's public disclosure of a backend loaded quarter and his refusal to discuss future projections or whether it was caused by the CFO's disclosure of flat projections in the private calls in the minutes and hours that followed? Perhaps I was a bit hasty in assuming that the class action hounds would be salivating at Alger's story. SC
