I'm pretty sure that you can determine tax lot, but you are supposed to make the election at the time of sale. I would just document my records according to tax lots as I deem appropriate, and report it that way.

I do not belive there are currently any FIFO requirements. There was a proposed reg, but I think it was shot down.
