While I appreciate Arcane Lore help in shedding light on the LTV case, there clearly is no valid parallel with the large "naked short" position on ZSUN. LTV story is that of a clever (he warned about the discrepancy) shorter's bet on a fairly safe arbitrage between the inflated value of LTV's shares and its underlying Warrants.
Fahnestock, on the other hand bet that ZSUN would be a push-over and that it could drive its stock down to $2.00, or so, making a huge profit in the process. Unfortunately, they won't aware that OIA, a "cash cow" of great potential had just been acquired bringing along its tremendous cash flow. Neither did they reckon with a few determined Longs that were prepared to dig in their heels and defend the stock on the Boards.
In addition, the SSB's were under the impression that ZSUN had something to hide and would try and avoid any form of Discovery. Wrong assumption again, as ZSUN sued you and seven others and also Stinky Stock Defective. BTW, it got its just reward, as I called it an excellent short at $15.50 and it's now at $7.60 and falling... NASD and SEC have now received a large number of requests to investigate Fahnestock for the alleged illegal sale of numerous "naked shorts" way in excess of what would be reasonable to provide an adequately regulated market. So, if an enquiry begins, guess where it'll start...
In Conclusion, earning news should be released tomorrow, followed by the 10SB Form and the application to list on AMEX or NASDAQ, all of which should contribute to Fahnestock losing a few more Millions on this SHORTING FAILURE. If they keep on the "offer", they increase their potential loses; if they step off, the stock SHOOTS to ZUN! Either way, they're TOAST!...
