Price Monger - I certainly agree that "the problem wasn't nearly as bad as everyone causied it to appear when they drove the stock price to the ground."
It is interesting that the lawsuit in Coms is for driving the stock price up in the previous quarter with the $.06 above forecasted earnings report. This is different than what we were talking about.
The contention is that the management artificially drove the stock up so that management could get out in late December and Early January. I have to admit it looks bad for COMS management here since they seem to have sold $8 million in Dec and $16 million in early January with Eric B. himself unloading 60,000 at 72-75 or 4.8 million. (But his total holdings have now slipped from $33 million down to $13 million - so if you add back the 4.8 million he got away with he has still taken a hit of 15.2 million on COMS stock.) Do we consider him a victim for losing 15.2 million with the rest of us or do we blame him for getting away with the $4.8 million? I guess the lawsuit depends on whether there is evidence of inflating the stock price and earnings earlier.
Also when were the announcements about slow sales in January? I assume they were after the January 6 sales date.
