RTev, the last i read was that AOL is willing to negotiate with MSFT.
Why would they want this? Could it be that AOL does not want to be portrayed as a bully? These kinds of tactics will not really help in their lobbying efforts for access to cable lines. So, might as well strike a deal with MSFT and be Mr. Nice Guy again.

MSFT has nothing to lose with this strategy. I am sure they lost a lot of customers (or potential customers) due to the anti-trust case. That also had the effect of helping others in the industry.
MSFT was at one time probably the most admired company (not sure of the dates..) but they had slipped. Now in order to protect their internet interests or plans, they have moved to paint AOL as the bully especially since Yahoo (a Mr. Nice Guy) is also being given a hard time by AOL.
I realize MSFT goal was interoperability (sorry for the spelling) but this other goal can't hurt them in the anti-trust or public opinion court. Certainly the smaller ISPs will appreciate MSFT's efforts to get to the AOL base---could lead to licensing agreements or something.
Just another tactic to make sure there is no gorilla in this jungle except of course Microsoft!
