New York Judge Rules Internet Gaming is Illegal

New York (AP) - A Manhattan judge ruled New Yorkers who gamble via the Internet are playing in a "virtual casino" inside their computers and are subject to state gaming laws.

State Attorney General Eliot Spitzer hailed the decision against World Interactive Gaming Corp., as a victory for his office's Internet Bureau.

The case began as a probe into allegations the Suffolk County, N.Y., concern had improperly sold shares in a casino-gambling business, earning some $1.8 million from 114 investors, 10 of them in New York. State investigators later tapped into WIGC web sites and discovered the gaming, according to court papers. The company said because its computer servers were located and licensed on the Caribbean island of Antigua, the state had no jurisdiction.

In a 20-page ruling, State Supreme Court Justice Charles Edward Ramos dismissed the company's claim. "The act of entering the bet and transmitting the information from New York via the Internet is adequate to constitute gambling activity within New York state," he said.

Judge Ramos said WIGC violated state and federal laws. WIGC couldn't be reached for comment.
