Well David answered the question - MM's do have to borrow, but they get more wiggle room than everyone else.

I shouldn't think there are any problems borrowing GLIA (although I haven't actually tried).

What on earth would you tell the SEC? That the stock is weaker than it "should be?" There are enough legitimate possible reasons for a decline (varying from hidden shorts to dumb institutions) that I just don't think they would show any interest.

I would certainly like to see the regulations changed to force hidden shorts to be revealed. This could be done by requiring the MM's to disclose any short position that is a match against some offsetting contract.
