It was a complicated offer but part of it was to buy from the public. Every shareholder was mailed documentation on the tender offer, you could enter the number of shares you wanted to sell. Of course nobody did it, but anyway that was a while ago and there is certainly no assurance he would make the same offer again so its kind of moot.
