Shorting against the box for purposes of paying long-term rather than short-term capital gains is no longer allowed. When one shorts against the box, it is considered a "constructive sale". Now the only reason to short against the box is for purposes of avoiding the uptick rule when one wishes to go short a stock during a downturn.
