Is Datek ripping me off???

I had a stop market order triggered on July 20 to sell SUNW with an activation price of 71 7/8 and got filled at 71 3/8. The order was activated at 9:50:49, and was executed at 9:53:44.

Datek has finally provided time and sales data which shows that after my order was activated until it was filled almost 3 minutes later:
10,900 traded at 71 7/8 (my activation price)
32,100 traded at 71 13/16
48,500 traded at 71 3/4
etc . . . for lower price levels . . .
There were no unusual gaps which could explain my bad fill. The trading levels fell in a generally linear manner as one would expect.

I have demanded that they process the trade at my activation price and credit my account accordingly. With these kinds of volumes I question why they could not fill my order at, or very near my activation price.
They claim the order was routed appropriately.

What recourse do I have if they do not fix this to my satisfaction?
I welcome any advice or comments.
