Kit,

If you haven't sold BCHPE yet (or it lies in your IRA account), then you are out of luck for Tax year 1996.

To claim it as a capital loss in 1997, sell it. And hope that you have a capital gain that you can apply it against.

My wife's position is in her IRA, so she is out of luck. We'll be holding BCHPE for years hoping for a reverse merger deal in the future.
