NEW YORK, Aug 3 (Reuters) - The chief executive of software
maker Novadigm Inc. <NDI.V> said on Tuesday he was unconcerned
about a lawsuit filed by rival Marimba Inc. <MRBA.O> alleging
patent infringement.
CEO Albion Fitzgerald said in a telephone interview that
Novadigm's technologies had been in use since 1994.
"Our technology for updating computing devices has been in
the marketplace since 1994, long before Marimba filed its
patent application in 1996," he said.
The Marimba suit, filed on Friday in U.S. District Court,
Northern District of California, San Jose division, did not
specify which Novadigm products were considered to infringe
their patents.
Marimba's attorney Doug Lumish declined to detail which
products were in question, but said Marimba's technologies have
changed since its patent application and they are not covered
under "prior art" provisions.
Novadigm is based in Mahwah, N.J.
