is there a NASD or SEC rule that specifies that that I am owed a fill at the if the bid after my order was activated is greater than the price at which I was filled?

No, there is no such rule nor could there be. Whether you might get filled at such a bid depends on the number of shares offered at that bid and the current market demand.
