I would say totalitarianism is impossible when the individual has unutterable rights against the state, and a material possibility to enforce their realization (by independent courts) and define totalitarianism as the assumption that the state's rule over the individual is total (= unlimited).

In this aspect Nazi Germany and Eastern European Socialist/Communist states were equal, and even there was a lot of similarity in the means of totality-enforcement.

Still they are not equal, and quite different in core aspects both practical and theoretical.

It seems strange to me that TB seems to assert theoretical equality (in hi proof) when earlier he has already noted the main difference between both totalitarian systems and any democratic state.
