I don't think when need to worry about the Justice department. NTOP is a still a shrimp (although it may be the biggest shrimp in its category). I think IDTC/NTOP would be more worried about pissing off AOL. This is especial a concern given the battle going on between AOL and MS over instant messaging. What AOL would do if NTOP/IDTC made a deal with MS to be on their instant messaging service I don't know. They have a four year agreement that provides some protection, but you never know.
