An issue that's been bothering me lately is the FTC investigation. It seems so unlikely that there will be a negative outcome, but you never know with a department of the federal government. Logic doesn't always prevail.

Why would it take until next year to resolve?

Can't it be easily shown that the deal with Lilly doesn't effect when the generics of the original Prozac can be marketed?

Isn't clear that the ICE is a different drug entirely and that it carries a unique patent?

Bottom line; what is the chance that the FTC will make a huge mistake and block the Lilly/Sepracor deal?

Any thoughts would be appreciated.

Dave
