The importance of the FTC prozac case is that it potentially impacts the entire Sepracor pipeline. If their ability to license patents to innovators is diminished, this decreases the value of every drug in their pipeline that is earmarked as "license to innovator" which encompasses greater than half the Sepracor pipeline. The resolution therefore is far more impacting then simply clearing or negating the LLY/SEPR deal. No matter what spin a DS may put on it, if the deal is nixed, it is decidedly negative on the company. I'd also note there is a broad range of resolutions the FTC could decide. Its not as clear as "yeah, or nay." New brand name, different indications are possibilities; etc etc etc.

I expect the deal to be cleared if for no other reason than not being able to make an argument against it.

For anyone who thinks that Barr brought this on, the FTC is also investigating them and their sweetheart deals with Zeneca and Bayer. Andrx/HMR deal is under investigation as well. I think its all under one roof but I may be wrong on that.
