Re: Additional info on Q v. Mot lawsuit
Various folks asked for more detailed information concerning the specific patents expressly involved this lawsuit. In addition, last week Q amended its complaint to provide supplemental information to the court concerning the three specific patents which it alleges that Mot has infringed. Those patents are:
1. 5,732,341 Method and Apparatus for Increasing Receiver Immunity to Interference (Issued 1998); 2. 5,754,542 System Determination in Multi-Mode Subscriber Station (Issued 1998); and 3. 5,842,124 User Programmable Service Programming of Cellular Phone (Issued 1998).
Q alleges that Mot has been infringing on these patents by it manufacture and sale of CDMA Dual-Mode (CDMA/AMPS) wireless phones. Q seeks: an order that Mot is enjoined/restrained from infringing on these 3 patents; monetary compensation ("not less than a reasonable royalty"); and treble damages pursuant to 35 USC 284.
This case has been consolidated with the previous, related cases between Mot and Q (5 cases pending since 1997). In addition, both Q and Mot stipulated to have this new case covered by the same protective order that controls those prior cases.
For those particularly gifted and/or interested in the patents (i.e. anyone still awake after the foregoing!), the newly amended complaint attaches copies of the 3 previously identified patents. It also lists the following categories of patents:
