I think it's a matter of time. All it will take is for a majority of band council members to decide to pursue negotiations with Sungold. My understanding is that the band's lawyers were basing their case on being considered as a nation and above state contract law. The federal court said it has no jurisdiction, so the band's case is essentially kaput. To make things worse for them, the DOI is clearly not going to grant recognition until this litigation is settled. It must be depressing for band members to know that the federal agency which is supposed to be in their corner, has effectively said that the band has to honour pre-existing contracts. Since the DOI has made that decision, I imagine that a state judge's decision will be even more prejudicial against the band. I suspect that some of the band members are beginning to see the writing on the wall.

I'd hazard a guess that if a majority of council members decided tomorrow to pursue negotiations with Sungold, they could probably start by Thursday and be concluded in a few weeks. Once the litigation is settled, I expect the DOI will provide their answer to the Detroit question and then grant recognition very quickly. The band could be up and running as a nation with prospects of a profitable business as soon as the end of September. Surely there are some band members who would prefer that to what could turn out to be a painful, revealing, lengthy, expensive round of depositions.
