3Com Suit Prevents Sale of Competing Handheld

August 13, 1999 -- 3Com Corporation, parent company to Palm Computing, has won a preliminary court order preventing the sale of Olivetti's competing Royal daVinci palm-sized handheld.

3Com had claimed the DaVinci's operating system violated the copyright for the Palm OS and the United States District Court for Northern California agreed. The court granted a preliminary injunction preventing the distribution, sale, import or export of the daVinci and the software development kit (SDK) for the device. CompanionLink Software had been distributing the SDK for free.

Palm filed the suit on July 22 in California and, the day before, had filed a parallel copyright infringement suit against Echolink Design Ltd. in Hong Kong. Echolink developed the operating system in the daVinci. The same day 3Com filed the suit in Hong Kong, the court there restrained EchoLink from distribution and sale of source code.
