Either all on-line pay-and-purchase schemes of any kind are covered by this patent (in which case it is ridiculously overbroad), or there's some scheme that is not covered (in which case, that's the scheme companies will switch to). Of course, that's a rational argument, and rationality has little to do with this situation. The founders of this company specialize in making money the slimiest way possible, as mentioned in an earlier posting:
"Fink, the patent attorney who is 1/3 of the E-Data
braintrust, was formerly of Refac, the patent exploitation firm.
Refac specialized in finding patents that seemingly cover some
popular product and under the threat of litigation, try to
settle. Refac just entered into settlement with NOVL over some
patent. Keep in mind that patent litigation is very expensive so
companies are often disposed to settle for an amount less than
expected litigation costs. Also, the strategy of securing an
early settlement with name players and offering amnesty is
typical Refac patent exploitation strategy."
At least the rest of us can go along for the ride. (But I'm too busy trying to creat real value with real inventions.)
