are you referring to QoS here, or do you mean using a fair weighting algorithm to ensure that everyone gets a shot at best effort. Or both?

Dont know for sure what is needed for open access to work. Neither does anyone else yet I think.

What would be most ideal in my opinion to set free the forces of the market would be a way in which the MSO's (or @home) could auction off digital bandwidth to various ISP's. "@home networking" would buy analog bandwidth (Hz) wholesale from the MSO's and then partitian off fixed amounts of bits/sec to resell to any ISP willing to pay the price in open auction. Only then could "@home ISP" and the other ISP's compete fairly.

Under these circumstances I would completely agree with gpowell's proposals. ATHM should set itself free from the MSO's, though I dont know how they would pay off the equity investment the MSO's own in ATHM.

This is a completely different level of operation than user QoS, however some creative engineering might be able to approximate the ideal using the kind of QoS features being developed today.
