[USRX suppositions]

<<<I suspect, but am not certain, that AMTX might be allowed, if it had sufficient bargaining power, to require TI to supply AMTX first, or to give AMTX "most favored nation" status (i.e., a price at least as low as what anyone else pays TI), but could not prohibit TI from selling the TI DSP containing AMTX technology (line code?) to anyone, including USRX.>>>

First off, let me set your mind at ease. Amati has first rights to TI's chips and preferrential pricing, as well. They also do not have to give away the license. The ANSI standard clearly states "fair and equitable" pricing.

<<<At least until such time, if ever, that X2 becomes an ANSI standard, USRX could prevent AMTX from making a "universal" modem, even though AMTX could not prevent anyone from using the TI DSP chip containing AMTX's patented DMT technology.>>>

Why would Amati want to make a modem with 56K capabilities? Wouldn't this be like adding foot-peddals to a Ferrari?

<<< Also CAP is much more prevalent today and a CAP solution gets them into trials.>>>

In what way is CAP more prevalent and how does a CAP solution get them into more trials? Please be specific.

While I appreciate your taking the time to analyze the 56K vs. ADSL scenario at USRX as you see it, your argument has so many qualifiers such as "perhaps," "it's likely," "probably," "if," and "might be," I don't know what to make of it. What are you asking?

Regards,

Pat
