I suspect that what's really going on is that there are economic benefits to the system as it stands now ~ the federal government taxes citizens more highly than they've ever been taxed, but turns the money over to the states in the form of "block grants." The block grants are used to fund programs that are unconstitutional, but the states don't have to take the money if they don't want it. Well, not that much gets turned down. It's a devil's bargain.
