Well, the preliminary response spells trouble.

An Inprise spokeswoman said: "These policies and procedures are pretty typical and they're general guidelines used by a public company and consistent with Delaware law."

The lawsuit "has no real merit and we intend to defend the company vigorously," she said, adding that the board is discussing with its lawyers a response to the suit.


Anybody with a 5% share or greater in this company is important to it going forward. Take twenty people like that and you own the company, lock stock and barrel. Pretty important I would say. Inprise claims this guy just launched a lawsuit that has no merit. I don't believe them, not for a second, and neither should anybody else.

Fuller doesn't need the money, this is a personal challenge, although he's wagering your money. Coates has a $18 million riding on this. Who do you think best represents investor's concerns? Giving Fuller the same ticket that was given to Del, minus the gillion bucks in salary, is not going to turn this company around. They are way too small and they have way too much competition. The worst part is they don't even know what's wrong. Dale thinks he knows: "they just need some minor adjustments". One thing we know for certain: any chance of an acquisition is history for at least a year.
