From what I heard, Van Buren knowingly allows naked short selling of any IPOs any time so long as the daytraders close out their trades by the end of the day. Even without the underwriters approaching the SEC, the latter has already been cracking down on such and other illegal practices since the Atlanta incident.

The market makers in the equity can still short the stock any time they want, but the daytraders who have been riding the shorting mms' coattails will soon come to an end.
