Law enforcement and new technology is always an interesting issue. Here's the essential problem: many crimes have been hatched, and discussed over the telephone. Wiretaps have been used for a long time to catch such criminals (such as Mafia leaders, etc). Now let's say Mafia Leader A says to Henchman B--"hey, let's use e-mail or instant messaging from now on." Should the classic law enforcement techniques now exclude "wiretapping' of e-mail or instant messaging? What if I set up a website called: "www.LetsBombAFederal Building.com.", and I ask assistance with plans, materials, etc. Should the FBI be banned from looking into this? There's always a tension between legitimate free speech concerns and the need to somehow head off or detect murderous or dangerous activities. If the FBI ignored a treacherous plot being planned over the Internet, and something horrible happened, we'd all ask why nothing was done. We have to rely on the courts to rein in any governmental abuses that could arise in this area.
