On or about June 15, 1989, Groundwater Quality Protection Permit No. G-0077-13 was issued to Carl's Santa Maria Mine, PN Mining Corporation, 3939 East Coronado Drive, Tucson, Arizona 85718.

According to the Mining Division of the Aquifer Protection Division, this permit is valid but inactive. They were told that the property was transferred to the Santa Maria Mining Co. and that they would file an application to activate in April but never received the application.

The steps for activation are as follows.

1. Pre-application meeting with the AZDEQ.

2. Submit application for an Aquifer Protection Permit or waiver.

Since this permit was filed under the old ground water protection plan and then became inactive, the activation process now involves compliance with the newer Aquifer Protection Plan.

The Department was aware that the property was transferred to Santa Maria Mining but SMM has yet to follow up on the activation. The Department has never heard of Orex but says they will have to follow the same procedure.

I hope they can do this in 3 weeks.

Disclaimer; I was told this information over the phone by a lady who represented herself to work for the Mining Division of the Aquifer Protection Program. I would suggest that other investors verify this information.
