Suzanne, the accountants do not have to worry, such accounting benefits (the credit of $4 MM or so) can be reversed once the court brings down its ruling. The company should worry since there is no doubt that if some of this $4 MM is due to the IRS (and that is separate from the sum due to the IRS from TSIG for which the IRS has a lien on some of TSIG's property), any money coming in from additional funding will have to go to pay the IRS on that.
