It's the Tribe's turn to perform now.

Now that the State has the authority to decide about the Band's contractual obligations, and now that it appears that the Tribe has been recognized, the terms of the existing contract are critical. My understanding is that the Tribe, having been recognized, has an obligation to the company to put land in trust with the DOI for their ancestral homeland, and also to establish a Class III casino. The clock is now ticking for them.

My understanding of the DOI's decision is that the Secretary of the Interior has effectively said that Detroit can not stand in the way of a casino at Toledo Beach. This is a strong signal to Engler and the State legislature that Babbitt, or whoever is SOI, will equally not allow the State to stand in the way.

I suppose it's conceivable that some members of the Tribe might want to opt for a different location. If that is the case, then they have a limited amount of time to settle with the company for the agreement they have already signed for Toledo Beach.

In any case, the Tribe is now on a fast track towards assembling a land package, financing, and operator for a casino. That whole package has to go to NIGRA (Nat'l. Indian Gaming Regulatory Authority) for adjudication in the near future.

It looks like Sungold's belief that the Band would be recognized has been substantiated.

I imagine that members of the Tribe are feeling a tad elated just now. So they should. I'm happy for them. Now, if they really want to brighten things up for themselves, they'll get of the fricken pot and settle this inane legal business and get on with what could be a very bright future.
