We've had our share of naysayers, but I believe that you've misunderstood the point of the complaint to the SEC. I believe he is complaining about what appears to be market-maker manipulation in NPEC. I have long believed that someone was purposely generating volume and/or price movement (usually down) within a relatively narrow range (+/- 3 cents or so) in order to be able to profit from those who are easily induced to sell.

If market-makers are manipulating NPEC, I have no problem with the SEC looking at their part in the trading. Many times several months ago there would be trading of what looked like mostly buys throughout the day bringing the price of NPEC up a few cents only to have it knocked down by someone at the very end so that there was no gain or a small loss when all was said and done.
