Why? There are plenty of other barriers to entry than simply patents. There are plenty of market leading companies whose products and services are not protected by patents, but for which there are still significant barriers to entry. The list of non-patent barriers to entry is pretty long: R+D of similar or better product, coding and testing, successful manufacturing, hiring the people to do it, paying the people to do it, successful marketing strategy, etc. and so on...
