There are plenty of market leading companies whose products and services are not protected by patents, but for which there are still significant barriers to entry. The list of non-patent barriers to entry is pretty long: R+D of similar or better product, coding and testing, successful manufacturing, hiring the people to do it, paying the people to do it, successful marketing strategy, etc. and so on...
