Well, as heinous as it sounds, I don't think this would be easy to prosecute as a crime whether abortion is legal or not, again for the reason that miscarriage is a natural act that occurs for many reasons... criminal behavior with regards to a fetus in the womb is really a can of worms. For example what is the difference between your description there and a woman ODing on some drug... well, that sounds like something that could be prosecuted... but what if it wasn't intentional - or a drug interaction issue, or her husband just left her (emotional duress). Here lies the chasm of regulating someone's treatment of their own body. What they do more of (maybe for legal reasons) is regulate the procedure or drug... as in abortion, no abortion procedures, or no heroin or whatever. But to prosecute a heroin injection to a fetus above and beyond the crime of use in the adult... I don't think legal regulation here is possible.
