It depends on the circumstances and whether there is a hate crime law in Texas. Actually I do not believe that Texas has a hate crime law so I guess it cannot be a legal hate crime.

If Texas had a hate crime law like Chicago then it would be investigated as a hate crime because religious affiliation is part of the law.

Unfortunately the death toll has increased to eight. There have been no reports about the motive.
