DAK7 .. JAWS first filed last October and the filing included the convertible debt financing (floorless). By the time the SEC got around to looking at our filing, they decided that they would no longer accept a floorless CDF. Of note is that our "sister" company, FutureLink, filed earlier than we did - in August - with a very similar financing - and it was accepted. As "they" say in most things, timing is everything. So JAWS reworked the TK financing in March to eliminate the floorless nature of it and refiled in May. Then we were advised to tweak it again so that it didn't read like a financing document, so another version was filed on September 1. This has been a very time consuming and frustrating experience but, as Robert said, the approval will be this Fall. A NASDAQ listing is another issue. Among other things, we must be fully reporting and have a stock price of $4.00 for 40 consecutive days before we can apply for a listing.
