IMHO a merger should have little effect on determining infringement and validity. Unless by providing more cash for legal fees the defendants lawyers are able to do a more thorough job. I don't think that is the case since there are so many defendants working together already, the defense (at least to validity) should be quite thorough without a merger.

It could affect settlement value (and future royalties) by diverting c-serve away from their allegedly infringing activities, and towards AOLs presumably non-infringing activities.

Since most of us speculating appear to be doing so on the basis of past damages, the future activity should have minimal impact.
